Vienna Police Report: Yorkie on the Loose, Inadvertent Sexting, Phony IRS Scam

Some of the most recent crimes that have taken place in the Town of Vienna.

The following summary contains various incidents of general interest as well as vehicular crashes handled by the Town of Vienna, Virginia Police Department from July 18-24. Readers are reminded that an “arrest” is based upon probable cause and does not always mean that someone was physically taken into custody. Furthermore, it does not mean that an individual is automatically guilty of a crime. Judicial outcomes and post-arrest proceedings can be researched through the appropriate court’s website.

Fraud 14-08289 700 Block Hillcrest Drive, SW Between July 14 at 12:00 p.m. and July 22 at 12:00 p.m. A resident reported that she received a letter from her bank informing her of several accounts that had been opened in her name. She stated the accounts were opened without her knowledge.

This case is being investigated.

Police Service 14-08093 Vocelli’s Pizza 334 Maple Avenue, West July 17 7:30 p.m.

A resident reported he had gone to Vocelli’s Pizza to pick up an order. He stated that although he eventually received the correct change he felt the employee was rude and talked to him in a threatening manner.

Petit Larceny 14-08122 400 Block Marshall Road, SW Between July 17 at 8:00 p.m. and July 18 at 7:00 p.m. A resident reported that someone had taken the 2016 registration stickers from his vehicle’s license plates.

Telephone Case 14-08099 300 Block Broadleaf Drive, NE July 17 8:43 p.m. A resident reported that her daughter had received inappropriate photographs to her cellular telephone.

MPO Shaw responded and telephoned the sender of the photographs who apologized and informed him the photographs were meant to be sent to another number.

The mother was informed of the mistake and did not wish to pursue charges.

Arrest – Driving While Intoxicated/Refusal/Drinking While Driving - 14-08083 100 Patrick Street, SW July 17 9:22 p.m. Sgt. Elias was on patrol when he observed an individual operating a vehicle, while drinking a can of Miller Lite. As a result of that observation he conducted a traffic stop. Upon his interaction with the driver he detected the signs of possible impairment.

After failing to complete a series of field sobriety tests Sgt. Elias arrested Mr. Richard A. Fill, 45, of Patrick Street, SW in Vienna for Driving While Intoxicated. Mr. Fill was transported to the Fairfax County Adult Detention Center, amid a barrage of insults, where he was provided the opportunity to submit a sample of his breath for analysis, however he refused.

Mr. Fill was charged with Driving While Intoxicated, Refusal to Submit to a Breath Test, Drinking While Driving and Driving on a Revoked License/Habitual Offender.

Mr. Fill was held without bond.

Vandalism 14-08255 200 Block Cedar Lane, SE Between July 18 at 12:06 a.m. and July 22 at 12:06 a.m. A resident reported that his bicycle had been damaged while secured to a sign in the parking lot of the Cedar Lane Shopping Center.

Fraud 14-08142 200 Block Glen Avenue, SW July 18 2:45 p.m. A resident reported her husband had received a telephone call from an individual claiming to be an employee with the IRS. The caller informed her husband that an unspecified amount of money was owed for back taxes and criminal charges would be pending if the amount was not paid.

The husband contacted his wife who immediately recognized this as a scam and refused to return the telephone call.

Civil Matter 14-08123 Wolf Trap Motel 430 Maple Avenue, West July 18 8:05 p.m.

A motel guest reported that he had been staying at the motel with a friend. He stated he and his friend had a disagreement and his friend would not let him re-enter the room to retrieve his personal belongings.

MPO Smith responded and after speaking with both individuals, entry was granted and the property was relinquished.

Found Property 14-08165 Magruder’s Grocery 180 Maple Avenue, West July 19 5:15 p.m.

A citizen responded to the Vienna Police Station to turn in an identification card she had found in the parking lot.

The identification card will be held at the Vienna Police Station until the owner can be contacted.

Domestic Assault 14-08167 200 Block Manvell Road, SE July 19 8:33 p.m. A resident reported that she and her husband were involved in an argument that escalated when the husband pushed her mother.

Officer Tremont responded and spoke with the mother who did not have any visible signs of an assault. The husband left the residence prior to the arrival of the police.

Officer Tremont informed the mother of the warrant process should she wish to pursue charges.

Animal Case 14-8168 Tapawingo Road at Desale Street, SW July 19 8:44 p.m. Officer Herrera responded to the area for the report of a small golden Yorkshire terrier dog that had been found running loose.

After an exhaustive attempt to locate the owner Officer Herrera transported the dog to the Fairfax County Animal Shelter where it will be held until the owner can be identified.

Grand Larceny 14-08179 9600 Block Counsellor Drive, NW July 20 2:30 a.m. A citizen reported that while attending a party, she had been using her iPhone to provide music for entertainment. She stated when the party ended she went to get her iPhone and discovered it had been taken.

She stated that approximately 40 attendees were at the party with only a small group being known to her.

This case is being investigated.

Arrest - Assault 14-08190 Radio Shack 322 Maple Avenue, West July 20 12:48 p.m.

A customer reported that he was attempting to return a defective piece of merchandise when a verbal argument between the store employee and the customer ensued. The argument escalated when the employee struck the customer in the face.

Officer Slebonick responded and after speaking with both individuals involved he informed them of the warrant process should they wish to pursue charges.

Later that day Officer Slebonick received notification that a warrant had been obtained by the customer charging the employee with Assault and Battery.

Officer Slebonick responded back to the Radio Shack where Mr. Alejandro Jose Garcia, 27, of Springstone Drive in Clifton, Virginia was served with a summons for Assault and Battery.

Mr. Garcia was released after signing the summons.

Civil Dispute 14-08192 9600 Block Counsellor Drive, NE July 20 1:56 p.m. A resident reported that neighbors had been harassing her after having a party at her house the previous night. The neighbor informed the resident that if she continued having loud parties the police would be notified.

Found Property 14-08200 9600 Block Counsellor Drive, NW July 20 5:14 p.m. A resident turned in a Social Security Card that had been found in the roadway.

The owner of the card was informed the card would be held at the Vienna Police Station until he could make arrangements to pick it up.

Arrest – Drunk in Public 14-08205 100 Block Park Street, SE July 20 10:02 p.m. Officer Herrera responded to the area for the report of a suspicious individual sitting in the parking lot. Upon his interaction with the individual he determined he had been drinking in the parking lot and was intoxicated.

Officer Herrera arrested Mr. Daniel Lawrence Schuman, 49, of Madison Court in McLean, Virginia for Drinking in Public and Drunk in Public.

Mr. Schuman was transported to the Fairfax County Adult Detention Center where he was to be held until he was sober.

Arrest – Alcohol Violation 14-08206 East Street at Ayr Hill Avenue, NE July 20 10:43 p.m. Officer Tremont was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the operator and occupant he determined that the occupant was in possession of alcohol and was under the age of 21.

Officer Tremont issued a summons to Mr. Brendan Michael Muha, 20, of Silkwood Court in Oakton, Virginia for Underage Possession of Alcohol.

Mr. Muha was released after signing the summons.

Suspicious Event 14-08207 200 Block Courthouse Road, SW July 20 11:01 p.m. A resident reported that a vehicle occupied by two juveniles, pulled up to his residence and began yelling at him. He stated the yelling intimidated him however no physical contact occurred.

Officer Herrera responded and spoke with the resident and his girlfriend, who was also at the residence. The girlfriend informed him that one of the juveniles was her brother who became upset after she informed him of an argument between her and her boyfriend.

Grand Larceny 14-08238 300 Block Moorefield Road, SW July 21 between 12:00 a.m. and 12:00 p.m. A resident reported that a friend had put her wallet and car keys in her mailbox and when she went to retrieve them she discovered they had been taken.

Arrest – Narcotics Violation 14-08211 200 Block Cedar Lane, SE July 21 1:03 a.m. Officer Tremont responded after a resident reported that an individual, who had been staying with his roommates, had stolen a bag of coins from him. The resident was able to describe the coins in detail to Officer Tremont proving the coins belonged to him. The resident, after having the coins returned, requested that the individual be informed that he was no longer welcome in the apartment.

Officer Tremont informed the individual of the resident’s wishes however due to his level of intoxication he was unable to provide positive identification to the officer. Due to not being able to provide proof of identity or his place of residence Officer Tremont arrested Mr. Jose Wilmer Ramos-Cedillo, 24, of Patrick Street, SE in Vienna for the Petit Larceny of the coins. While attempting to secure Mr. Ramos-Cedillo in handcuffs he began to resist requiring a second officer to assist in his arrest. After securing Mr. Ramos-Cedillo, Officer Tremont also located a measurable amount of an illegal narcotic in his possession.

Mr. Ramos-Cedillo was transported to the Fairfax County Adult Detention Center where he was charged with Petit Larceny, Resisting Arrest and Possession of a Schedule I, II Controlled Substance.

Mr. Ramos-Cedillo was held on a $7,500.00 bond.

Residential Alarm 14-08215 300 Block Locust Street, SE July 21 8:15 a.m. An alarm company reported that a residential alarm had been activated. MPO Sheeran responded and was met by a contractor who informed him the homeowner had hired him to perform work however the alarm had not been deactivated.

Telephone Case 14-08219 500 Block Walker Street, SW July 21 10:30 a.m. A resident reported that his ex girlfriend had been repeatedly calling him and sending him harassing and threatening text messages.

Officer Holcombe responded and telephoned the ex girlfriend who denied making the telephone calls or the text messages.

Both individuals were instructed to cease contact with one another and informed the resident of the warrant process should the telephone calls or texts continue.

Arrest - Solicitor 14-08224 900 Block Symphony Circle, SW July 21 11:53 a.m. A citizen reported that an individual had been in the area soliciting the sale of meat from a pick- up truck.

Officer Kiley responded and located the individual who stated he was attempting to sell off an order that a customer had previously cancelled.

Officer Kiley issued a summons to Mr. David A. Erickson, 39, of Bunkhouse Drive in Ft. Worth, Texas for Soliciting without a License.

Mr. Erickson was released after signing the summons.

Suspicious Event 14-08239 300 Block Moorefield Road, SW July 21 3:00 p.m. MPO Sheeran was in the area in reference to a grand larceny that occurred (See Case 14-08238) and discovered damage to the front door of the residence. Nothing else on the outside of the residence appeared suspicious.

This case is being investigated.

Vandalism 14-08260 100 Block Lewis Street, NW Between July 21 at 10:00 p.m. and July 22 at 8:00 a.m. A resident reported that someone had thrown eggs at her home sometime during the evening.

Arrest – Driving While Intoxicated/Refusal 14-08252 8500 Block Old Courthouse Road, NE July 21 11:31 p.m. Sgt. Farhan was on patrol when he observed the driver of a vehicle commit a traffic offense. As a result of that offense he conducted a traffic stop. Upon his interaction with the operator he detected the signs of possible impairment. After failing to complete several field sobriety tests he arrested a man for Driving while intoxicated.

He was transported to the Fairfax County Adult Detention Center where he was given the opportunity to provide a sample of his breath for analysis. He declined to provide the sample and was subsequently charged with Driving While Intoxicated and Refusal to Submit to a Breath Test.

He was to be held until he was sober.

Arrest – Alcohol/Narcotics Violation 14-08256 Marshall Road Elementary School 730 Marshall Road, SW July 22 2:13 a.m.

Officer Tracy was on patrol when he observed two individuals standing in the rear parking lot of the elementary school. Officer Tracy approached the individuals and while speaking with them he detected the odors of alcohol and marijuana. After further interaction he determined that both individuals, under the age of 21, had consumed alcohol. He also located a measurable amount of marijuana on the male individual.

Officer Tracy issued summonses to Daniel Robert Tobin, 19, of Clearfield Avenue in Vienna for Underage Possession of Alcohol and Possession of Marijuana.

Ms. Sarah Nickle, 19, No Fixed Address, was issued a summons for Underage Possession of Alcohol.

Mr. Tobin and Ms. Nickle were released after signing their summonses.

Civil Dispute 14-08314 100 Block Kingsley Road, SE July 22 between 8:00 a.m. and 10:00 a.m. Officer Slebonick responded for the report of a civil dispute between two neighbors. After speaking to both neighbors he determined the dispute had been ongoing since 2012.

Officer Slebonick informed both parties this was a civil matter and not a matter for the police.

Civil Matter 14-08290 Cuppett’s Performing Arts Center 130 Park Street, SE July 22 5:10 p.m. MPO Sheeran responded to the report of an argument between two individuals regarding vehicle damage that occurred when one vehicle’s door was opened into the other individual’s vehicle.

MPO Sheeran informed both parties this was a civil matter and not a matter for the police however both parties insisted that a police report be completed.

Arrest – Drunk in Public 14-08300 Maple Avenue at Mashie Drive, SE July 23 1:00 a.m. Officer Tracy was on patrol when an individual jumped from the sidewalk into the roadway into the path of his police cruiser. Officer Tracy stopped and spoke with the individual who stated he had been walking home from Jammin Java and became tired so he decided to hitchhike home. Officer Tracy provided the individual with safer opportunities alternatives to get home, all of which he declined. The individual was permitted to continue on his way with the assurance that he would stay on the sidewalk and make no more attempts to hitchhike.

A short time later MPO Shaver was on patrol in the same area when the same individual jumped into the roadway into the path of his police vehicle. MPO Shaver stopped and spoke with the individual who provided the same story as given to Officer Tracy. Upon hearing that MPO Shaver was with the same person he was with earlier Officer Tracy responded and determined was too intoxicated to make it safely home.

Officer Tracy arrested Mr. Steven Jay Oshinsky, 54, of Water Circle in Baca Raton, Florida for Drunk in Public.

Mr. Oshinsky was transported to the Fairfax County Adult Detention Center where he was to be held until he was sober.

Animal Complaint 14-08305 300 Block West Street, NW July 23 7:00 a.m. A resident reported that a raccoon had been in her backyard and appeared to be sick. The raccoon left the area prior to the arrival of the police officer.

ACO Barker will follow up with this case.

Petit Larceny 14-08310 500 Block Orchard Street, NW Between July 23 at 9:30 a.m. and July 24 at 9:30 a.m. An employee of a construction company stated that an individual had been taking scraps of wood from the construction site and when he confronted him he became rude and cursed at him and approached him in an aggressive manner.

MPO Evans responded and located the individual who stated he had been given permission to take the materials by another worker at the site.

The employee informed MPO Evans the items were not trash and should be returned. The individual returned the items and was told he was no longer permitted on the property.

Fraud 14-08330 200 Block Cedar Lane, SE July 23 6:07 p.m. A resident reported that someone had been using her juvenile son’s Social Security Number without her knowledge.

This case is being investigated.

Domestic Dispute 14-08334 Moorefield Hill Court, SW July 23 11:08 p.m. A resident reported she and her husband had been involved in a heated argument.

Officer Herrera responded and after speaking with both the husband and wife he determined that the argument had not turned physical.

Both parties agreed to stay in separate areas of house for the rest of the evening to avoid any further problems.

Domestic Dispute 14-08335 Block Hillcrest Drive, SW July 23 11:59 p.m. A resident reported he and his stepfather had been involved in a heated argument. Officer Herrera responded and after speaking with both individuals determined the argument had not turned physical.

The stepson agreed to stay with friends for the evening to allow for a cooling off period.

Arrest - Grand Larceny/Narcotics Violation 14-08337 Wolf Trap Motel 430 Maple Avenue, West July 24 1:11 a.m.

MPO Smith was responding to the Amphora Restaurant for the report of an individual who had become disorderly and was refusing to pay for a drink. Prior to his arrival the individual had left the restaurant. While speaking with the restaurant manager two diners informed MPO Smith that the individual had been talking with them and stated he was staying at the Wolf Trap Motel.

MPO Smith responded to the Wolf Trap Motel where he located an individual matching the description given by the restaurant employee walking in the rear parking lot and carrying a back pack. MPO Smith stopped the individual and after speaking with him he determined he had taken the back pack along with prescription medication from an unlocked vehicle parked in the parking lot. The owner of the items met with MPO Smith and was able to provide proof that the items were his.

MPO Smith arrested Mr. Jacob Turner Byrd, 25, of Furncrest Terrace in Ashburn, Virginia for Grand Larceny, Possession of Marijuana, Possession of a Schedule I, II Controlled Substance, Tampering with a Vehicle, and Drunk in Public.

The restaurant employee declined to pursue charges for the nonpayment of the drink.

Mr. Byrd was transported to the Fairfax County Adult Detention Center where he was held without bond.

Alcohol Violation 14-08338 Shell Gas Station 252 Maple Avenue, West July 24 1:20 a.m.

Officer Herrera was on patrol in the area when he observed a female, having difficulty maintaining her balance while walking on the sidewalk. Officer Herrera approached the female and determined her difficulty in walking was due to her consumption of alcohol, he also determined she was under the age of 21.

Officer Herrera transported the juvenile to the Vienna Police Station where she was counseled on the consequences of consuming alcohol under age and then her grandmother was contacted to take her home.

Fraud 14-08358 Capital One Bank 246 Maple Avenue, East July 24 3:18 p.m. An employee reported a female had entered the bank and attempted to cash a check that had been altered. The woman left the bank prior to the arrival of the police.

The original owner of the check was contacted and informed the bank that the check the woman attempted to cash had been place in his mailbox for pickup.

This case is being investigated.

CRASHES

Maple Avenue near Nutley Street, NW 14-08107 July 18 2:00 p.m. The driver of the first vehicle was attempting to exit a parking lot to travel west bound on Maple Avenue, West. The driver stated the traffic on Maple Avenue stopped to allow him to execute his turn.

The driver of the second vehicle was traveling west bound on Maple Avenue and upon seeing the stopped vehicles changes lanes to the center turn only lane, in an attempt to pass the stopped vehicles, and collided with the first vehicle.

The driver of the second vehicle was issued a summons for Unsafe Lane Change.

Cottage Street at Yeonas Drive, SW 14-08108 July 18 2:15 p.m. The driver of the first vehicle was traveling north bound on Cottage Street, SW approaching the intersection with Yeonas Drive, SW.

The driver of the second vehicle was traveling east bound on Yeonas Drive, SW and stopped at the intersection with Cottage Street, SW. The driver of the second vehicle stated she believed the intersection was a four way stop intersection and as she proceeded through the intersection she collided with the first vehicle.

The driver of the second vehicle was issued a summons for Failure to Yield the Right of Way.

1200 Block Cottage Street, SW 14-08120 July 18 6:00 p.m. The drivers of two vehicles, on opposite sides of the roadway, were attempting to back out of their driveways and backed into each other.

Maple Avenue near Beulah Road, NE 14-08217 July 21 9:14 a.m. The drivers of two vehicles were traveling west bound, in the same lane of travel, on Maple Avenue and stopped at the intersection with Beulah Road, NE.

The driver of the second vehicle stated the driver of the first vehicle backed into her vehicle. The driver of the first vehicle stated the driver of the second vehicle pulled forward rear ending her vehicle. There were no independent witnesses at the scene to confirm either driver’s statements.

Follin Lane at Echols Street, SE 14-08226 July 21 12:10 p.m. The drivers of two vehicles were traveling north bound on Follin Lane, in the same lane of travel, and stopped for the red traffic signal at Echols Street, SE.

The driver of the second vehicle stated she was reaching for her sunglasses and rolled forward rear ending the first vehicle.

The driver of the second vehicle was issued a summons for Failure to Pay Full Time and Attention.

Maple Avenue near Nutley Street, West 14-08347 July 24 10:09 a.m. The driver of the first vehicle was traveling west bound on Maple Avenue approaching Nutley Street, SW.

The driver of the second vehicle was traveling east bound on Maple Avenue and while attempting to turn into a parking lot she turned into the path of the first vehicle and caused a collision.
